कोंकण विभागातील वेटलँडसंदर्भात पाणथळ तक्रार निवारण समिती गठीत करण्याबाबत..शासन निर्णय दिनांक 02.09.2016

राज्यात वेटलँडचे संरक्षण करण्यासंदर्भात मुद्दे उपस्थित करुन वनशक्ती या संस्थेने मा. उच्च न्यायालय, मुंबई येथे जनहित याचिका क्र.87/2013 दाखल केली आहे. प्रस्तुत जनहित याचिकेची दिनांक 25.07.2016 रोजी सुनावणी होऊन मा. न्यायालयाने अंतरिम आदेश दिलेले असून त्यातील परिच्छेद (५) खालील प्रमाणे आहे -

Considering the need to protect the Wetlands in the State and for ensuring compliance with the interim orders passed by this Court, a Grievance Redressal Mechanism will have be created. We, accordingly, direct to State Government to constitute a committee headed by the Divisional Commissioner of Konkan Division to monitor the implementation of the interim orders passed by this Court in the Konkan area of the State. We direct that a representative of the first petitioner shall be a member of the committee. The State Government shall appoint Senior Revenue Officers working under the Divisional Commissioner Konkan Division as well as Senior Police Officers having jurisdiction over various areas of districts in the Konkan Region to be part of the committee. It will be open for the State Government to include any expert as a member of the committee. Even a representative of the Maharashtra Pollution Control Board shall be a part of the committee. Needless to add that all Planning Authorities within the meaning of the Maharashtra Regional and Town Planning Act, 1966 in the said districts of Konkan Region be given a representation of the committee."

प्रस्तुत प्रकरणी विशेषतः मुंबई उपनगर व ठाणे जिल्ह्यात वेटलैंड / पाणथळ क्षेत्राचा नाश झाल्याचे मा. न्यायालयाच्या निदर्शनास आले आहे. राज्यातील पाणथळ क्षेत्राच्या संरक्षणाची गरज लक्षात घेता, तसेच मा. उच्च न्यायालयाने वेटलैंड क्षेत्राबाबत सदर जनहित याचिकेमध्ये पारित केलेल्या सर्व अंतरिम आदेशांची अंमलबजावणी करण्यासाठी राज्य शासनाने विभागीय आयुक्त, कोंकण विभाग यांच्या अध्यक्षतेखाली एक पाणथळ तक्रार निवारण समिती गठीत करावी, अशा सूचना उपरोक्त आदेशान्वये मा. न्यायालयाने दिल्या आहेत. त्यानुषंगाने कोंकण विभागातील वेटलैंडसंदर्भात पाणथळ तक्रार निवारण समिती गठीत करण्याबाबतची बाब शासनाच्या विचाराधीन होती.
