महाराष्ट्र खाजगी वने (संपादन) अधिनियम, १९७५ अंतर्गत न्यायालयीन प्रकरणे सन्माननीय सर्वोच्च न्यायालय / माननीय उच्च न्यायालय मुंबई / जिल्हा स्तरीय कोर्ट आणि जिल्हा महसूल प्राधिकरण या विविध न्यायालयामध्ये खटले दाखल आहेत, याची आपणास जाणीव आहे. सदर न्यायालयामध्ये प्रकरणास सरकारच्या हिताचा विचार आणि त्याप्रमाणे कृतीची गरज आहे. महाराष्ट्र खाजगी बनें (संपादन) अधिनियम, १९७५ अंतर्गत न्यायालयीन प्रकरणे हाताळण्याकरिता संदर्भिय पत्राद्वारे आवश्यक मार्गदर्शन करण्यात आलेले आहे.
महाराष्ट्र खाजगी वने (संपादन) अधिनियम, १९७५ अंतर्गत न्यायालयीन प्रकरणांमध्ये विविध
न्यायालयात दाखल होणारे शपथपत्राचे प्रारुप वृत्तांकडुन या कार्यालयास प्राप्त होतात व त्यामध्ये या कार्यालयाकडुन संस्करण होवुन, आवश्यक सुधारणा करुन ती शासनास मान्यतेकरीता सादर करण्यात येतात. बरेचदा काही न्यायालयीन प्रकरणाचे शपयपत्रांमध्ये काही महत्वाचे मुचे नमुद करणे अनावधानाने मिटून जातात किंवा जोडपत्रा अभावी त्यामध्ये शासनाकडुन परत पृच्छा करण्यात येते, असे या कार्यालयाचे निर्दशनास आलेले आहे. यामुळे होणा-या वेळेचा अपव्यय टाळण्याकरिता व न्यायालयीन प्रकरणे तत्परतेने हाताळण्याकरिता यासोबत दिलेले यादीप्रमाणे व दिलेले निकषाप्रमाणे तपासुन घेणे आवश्यक आहे. करिता वापुढे महाराष्ट्र खाजगी वनें (संपादन) अधिनियम, १९७५ अंतर्गत न्यायालयीन प्रकरणांमध्ये शपथपत्र तयार करतांना दिलेल्या यादीप्रमाणे व निकषाप्रमाणे तपासुन ध्यावे व त्यानुसार शपथपत्र तयार करण्याची कार्यवाही करावी
Check list for preparing draft reply in cases relating to Private Forest (Acquisition) Act 1975.
CHECK WHETHER THE LAND PARCEL IN QUESTION FITS INTO FOLLOWING CRETARIA.
1. Forest - As per section 2(c-i)
2 [(c-i) "forest" means a tract of land covered with trees (whether standing, felled, found or otherwise ), shrubs, bushes, or woody vegetation, whether of natural growthor planted by human agency and existing or being maintained with or without humaneffort, or such tract of land on which such growth is likely to have an effect on thesupply of timber, fuel, forest produce, or grazing facilities, or on climate, stream flow,protection of land from erosion, or other such matters and includes-
(I) land covered with stumps of trees of forest;
(ii) land which is part of a forest or lies within it or was part of a forest or waslying within a forest on the 30th day of August 1975;
(iii) such pasture land, water-logged or cultivable or non-cultivable land, lyingwithin or linked to forest, as may be declared to be forest by the State Government;
(iv) forest land held or let for purpose of agriculture or for any purposesancillary thereto;
(v) all the forest produce therein, whether standing, felled, found or otherwise ;]
2. Possession taken or not the land is forest if it qualifies as Forest as per section 2(c- i) and 2(c-i)(iii) and it is private forest as per section 2(f).
3. Available proofs such as -
I). 7/12 Extract of 30.08.1975 showing that the land was not under cultivation.
(ii) Panchanama showing that there is good tree growth or the land is padit/grass land with trees.
(iii) Recent Google image and photos
(iv) Panchanama
(v) letter to Collector stating that the said survey numbers are acc MPF(A)1975 and mutation entries in the land record shall be e "forest" 2/3
vi) Any offence booked by Forest Department
vii) Details of Previous Court case.
4).Other corroborativeproofs (if available) such as -
i ) Notice under section 35(3) of Indian Forest Act, 1927.
(ii) Notification under section 35(1) of Indian Forest Act, 1927.
(iii) Relevant Gazette showing 35(3)/35(1) proofs. iv) Possession Receipt.
v) Village Committee Report.
